  • Is a salaried chef or kitchen manager exempt from overtime?

    Only if they pass all three federal tests: a salary of at least $684 a week ($35,568 a year), a primary duty of managing the restaurant or the kitchen, and regularly directing two or more full-time employees with real say in hiring and firing. Being on salary alone does not make someone exempt.

  • Can a manager, shift lead or owner share in the tip pool?

    Owners never can. A manager or supervisor cannot share on any day they have managerial responsibility, even if they also served tables. The Attorney General names shift supervisors, assistant managers, banquet captains and many maître d's.

  • Can a current or former employee see their personnel file?

    Yes. Within five business days of a written request, the employer must let the employee review their personnel record, and provide a copy on request, up to twice a year. You must also tell an employee within 10 days when you add negative information, such as a write-up, to their file.

Where restaurants go wrong

  • Judging a manager on labor percentage alone. It rewards sending people home and skipping breaks, which is where wage claims start.
  • Paying a bonus out of the tip pool, or letting a manager take a share on days they supervise. Fund manager bonuses from the business.
  • Assuming a salaried manager is exempt from overtime. The federal duties and salary tests decide that, not the job title.
