Can a current or former employee see their personnel file?
Yes. Within five business days of a written request, the employer must let the employee review their personnel record, and provide a copy on request, up to twice a year. You must also tell an employee within 10 days when you add negative information, such as a write-up, to their file.

You cannot pay someone less than employees of a different gender who do comparable work, meaning work of substantially similar skill, effort and responsibility under similar conditions, whatever the job titles say. You also cannot ask applicants about their pay history or stop staff from discussing their pay.

Only when all of these are true: you told the employee about the rule in writing, they customarily receive more than $20 a month in tips, they keep all their tips or receive them through a lawful tip pool, and the $6.75 plus their tips reaches at least $15.00 an hour. If any condition fails, you pay the full $15.00.

Where restaurants go wrong
- Promising a raise in the meeting and never sending the rate change to payroll. Write the effective date on the form and send it the same day.
- Rating everyone a 2 on everything. If the form says nothing, the next manager learns nothing from it.
- Raising a problem for the first time in a review. Anything serious should already have been said, and written down, when it happened.
